DOWN TO EARTH PHOTOGRAPHY PRIVACY POLICY

At Down To Earth Photography we are committed in safeguarding and protecting your personal data. This privacy policy explains what happens to any personal data you provide us, or that is collected while you visit our website and how we will treat this information.  

The processing of data such as name, address, email, telephone number shall always be in line with the General Data Protection Regulations (GDPR).

Who collets your data:

Lynn Patterson ("Owner") at Down To Earth Photography is the data controller responsible for your personal data. 
 

What do we collect:
 

We collect a variety of information when you enquire about or book our services. This includes:

  • Gender, names, addresses, phone numbers, email of person(s)

  • Gender, names, ages, date of birth of all persons participating in photo shoots

  • Weight of newborn and time of birth (optional, if client opts in) for a  short complementary video of gallery image. 

  • Payment Information:   requested services are invoiced and payment is made via bank transfer. Any credit/debit card payments and other payments you make will be processed by third party payment providers and the payment data you submit will be securely stored and encrypted by our payment service providers using up to date industry standards. Please note that we do not ourselves directly process or store the debit/credit card data that you submit

  • Other Information:    you may also provide us with additional information about yourself or other participants of the shoot that is relevant to help us prepare for your shoot, this may include but may not be limited to: allergies, health conditions, children behavioural patterns.

  • Photographs:    in providing our services we create photographs which may identify you and other participants and that may be considered personal data.  Our photographs may be produced in print and digital format.  You are responsible for ensuring that all participants have been provided with a copy of the signed contract and can refer to this privacy policy.

If you contact us via email or social media all messages are stored within our password protected email or social media accounts. 

We use password protected data management software to hold your data. 

How is your data collected:

  • When you fill in enquiry forms or make a booking ​through our website.

  • If you enquire or make a booking via email, social media or telephone.

  • If a 3rd party purchases a gift voucher for you they provide your name and contact details

  • If you provide your social media account name for sneak peak of images

Why we collect your data?

 

The data we collect is for the purpose of providing you with the service you have ordered or for the purpose of communicating with you about services you have enquired about. 

How will your data be used?

We use your personal information in the following ways:
 

  • to contact you regarding the use of our services, to provide you with our service.

  • to create and deliver digital and printed products to you

  • to comply with a) legal obligations, b) respond to requests from competent authorities c) protect our operations; (d) protect our rights, safety or property, and/or that of our affiliated businesses, you or others; and (e) enforce or defend legal rights, or prevent damage

  • with your consent, we may use the your images for promotion and advertising of Down To Earth Photography. This includes, but is not limited to: marketing material, displays at events and presentations. display inside the studio and on our website portfolio,  social media and online advertising.

  • We may use your personal data for other purposes which you have consented to at the time of providing your data.

We may send you offers for upcoming promotions via email or social media, you can unsubscribe or opt out at any time. 

​Disclosure of information:

We share your personal data with third parties in the following situations:

  • Service Providers: we sometimes engage selected third parties who act on our behalf to support our operations, such as (i) card processing or payment services (ii) IT suppliers and contractors (e.g. data hosting providers or delivery partners) as necessary to provide IT support and enable us to provide our goods/services, and (iii) providers of specialist services, including retouching, printers and framers. Pursuant to our instructions, these parties may access, process or store your personal data in the course of performing their duties to us and solely in order to perform the services we have hired them to provide.

  • Administrative and Legal Reasons: if we need to disclose your personal data (i) to comply with a legal obligation and/or judicial or regulatory proceedings, a court order or other legal process. (ii) to enforce our Terms & Conditions or other applicable contract terms that you are subject to; (iii) to protect us, our members or contractors against loss or damage. This may include (without limit) exchanging information with the police, courts or law enforcement organisation

We take the privacy of your personal data very seriously, we do not sell your data to any third parties.

Data Retention:

We will keep your personal data for as long as is reasonably necessary for the purposes outlined in this Privacy Policy, or for the duration required by any legal, regulatory, accounting or reporting requirements, whichever is the longer. We retain digital files of your purchased photographs for as long as we see necessary. Upon expiry of the applicable retention period we will securely erase your personal data in accordance with applicable laws and regulations.

Your data protection rights:

 

Certain applicable data protection laws give you specific rights in relation to your personal data. In particular, if the processing of your personal data is subject to the GDPR, you have the following rights in relation to your personal data:

 

  • Right of access:   you have the right to know what information we store, and you have the right to request a copy. 

  • Right to rectification:   if the data we hold is incorrect or incomplete, you are entitled to notify us and request that we update it.

  • Right to erasure:   you have the right to request your personal data be erased and we are obligated to comply without delay, if the personal data is no longer necessary in relation to the purposes for which they were collected.

  • Right to restrict processing:   you may ask us to restrict the processing of your personal data in certain circumstances, such as where you contest the accuracy of the data or object to us processing it. 

  • Right to object:   you may request at any time to stop processing your personal data and we will comply unless we can demonstrate compelling legitimate grounds for the processing which override your interests.

  • Right to withdraw consent:   if we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing of your data before we received notice that you wished to withdraw your consent.

  • Right to lodge a complaint with the data protection authority: If you have a concern about our privacy practices you can report it to the UK data protection authority or to any other competent data protection authority of an EU member state that is authorised to hear those concerns.
